1. Scope of Services & Overview
These Terms and Conditions govern advisory, consulting, and support services provided by Indie Abroad Consulting ("we", "us", "our") to prospective students and clients ("you", "client"). Our advisory packages include university application guidance, APS support, bureaucratic preparation, and student coaching.
2. Nature of Consulting & Admission / Visa Disclaimer
All consulting and guidance services are rendered on a service contract basis (Dienstleistungsvertrag). Indie Abroad Consulting provides expert assistance, strategy, and administrative preparation; however, ultimate decisions regarding university admission, APS certification, blocked accounts, and visa issuance rest exclusively with the respective universities, embassies, consulates, and German immigration authorities (Ausländerbehörden).
We cannot and do not guarantee admission or visa grant outcomes.
3. Pricing, Invoicing & Payment Terms
All fees for bespoke advisory packages or individual consultations are agreed upon in advance in written format (via official proposal or invoice). Invoices are payable before consultation milestones commence unless an installment schedule has been expressly confirmed in writing.
4. Right of Withdrawal (Widerrufsrecht)
If you enter into a remote distance agreement as a consumer, you have the right to withdraw from this contract within 14 calendar days without stating reasons.
Withdrawal Period: The withdrawal period is 14 days from the day of contract conclusion.
Exercising Your Right: To exercise your right of withdrawal, you must inform us (Indie Abroad Consulting, Email: contact@indieabroad.com) by means of a clear declaration (e.g., an email) of your decision to withdraw from the contract.
Consequences of Withdrawal: If you withdraw, we will refund all payments received from you without undue delay and at the latest within 14 days from the day we receive notification.
Early Service Performance Waiver: If you requested that consulting services begin immediately during the 14-day withdrawal period, you acknowledge and agree that your right of withdrawal expires once the consulting service has been completely performed. If performance is ongoing, you owe an amount proportional to services rendered up to the time of withdrawal notice.
5. Client Obligations & Document Authenticity
The client is solely responsible for providing truthful, complete, and authentic academic certificates, transcripts, and personal documentation. Indie Abroad Consulting bears no liability for rejections or legal consequences resulting from falsified, inaccurate, or delayed document submissions provided by the client.
6. Limitation of Liability & Applicable Law
Indie Abroad Consulting is liable without limitation for intent and gross negligence. For slight negligence, liability is limited to foreseeable, contract-typical damages resulting from breach of fundamental contractual obligations (cardinal obligations).
For consumer contracts, mandatory consumer protection laws of your country of habitual residence remain unaffected. Otherwise, contractual agreements are governed by applicable statutory law.
